Property and Water Rights Dispute

The firm was retained to jointly represent a local developer in a dispute related to the property and corresponding water rights to property located in the Shoals area.  The client purchased a large tract of real property adjacent to and surrounding a navigable waterway and intended to develop the property and waterfront by constructing riverfront residential lots, a marina, piers and boat slips.  After signing the contract, accepting substantial purchase proceeds, and knowing the developer’s intentions to improve the property and waterfront, the former owners wrongfully claimed that they still had an ownership interest in certain portions of the property.  The client is seeking a declaratory judgment, compensatory and punitive damages, injunctive and other relief.
