The firm successfully pursued claims for a poultry farmer and his wife arising from the denial of property insurance coverage for substantial theft losses. The insured denied the claim and contended that a policy exclusion voided coverage for theft because the property was vacant. The insurer contended the exclusion applied because the houses had not had chickens in them for several weeks at the time of the theft loss. The firm was successful in achieving a favorable settlement of $328,000 for the clients, which significantly exceed the amount of the property damages caused by the theft.
