Business Litigation

The law firm’s attorneys have successfully handled a wide variety of business disputes for both plaintiffs and defendants. Since 1996, the firm’s lawyers have recovered nearly $8 million for its clients who were plaintiffs or defendants filing counterclaims in this type of litigation. Many such cases have been successfully defended for other clients. The firm’s clients and their interests are as diverse as the types of cases the firm handles. Lawyers in the firm have been instrumental in defending Australian entities in a multi-million dollar lawsuit by a publicly-traded Chicago corporation involving breach of fiduciary duty claims and the corporate opportunity doctrine under Delaware law (Massey v. Disc Mfg., Inc., 601 So. 2d 449 (Ala. 1992)), and have also represented a widow wrongfully sued on a business guaranty for whom the firm obtained a confidential settlement on a counterclaim for malicious prosecution. Other business litigation handled by members of the firm includes multi-state litigation protecting investors in a construction business from a call on letters of credit posted in lieu of a bond on a multi-million dollar construction project, fraud and breach of fiduciary duty claims against the corporation in which these clients invested, achieving a $1.4 million settlement, lawsuits involving enforcement of restrictive covenants on commercial projects, litigation involving trade secrets and non-competition clauses, representation of medical professionals in practice or partnership disputes, defense of commercial developers, claims involving product recalls, shareholder derivative and corporate oppression/squeeze-out lawsuits, and other actions.
